These Terms and Conditions of Sale ("Terms") govern the sale of products offered on the online store operated by NAVIRAH via the Shopify platform. By placing an order, you agree to be bound by these Terms.

  1. Products

NAVIRAH sells Anti-Snoring Chin Straps intended for personal domestic use.

Each product includes a description outlining its essential characteristics, including materials, size, colour, and care instructions.

Product images are provided for illustrative purposes only. Minor variations may occur due to manufacturing differences or screen display settings and do not constitute defects.

  1. Prices

All prices are displayed in Euros (€) and include applicable taxes (TTC), unless stated otherwise. Shipping costs are shown separately before order confirmation.

NAVIRAH reserves the right to change prices at any time. However, products will be charged at the price displayed at the time the order is confirmed.

  1. Orders

By placing an order, you confirm that:

• You are legally capable of entering into a binding contract
• All information provided is accurate and complete

The order becomes final once payment has been successfully processed.

NAVIRAH reserves the right to refuse or cancel any order in cases of:

• Suspected fraud
• Payment issues
• Previous disputes with the customer

Payment is required at the time of order.

Accepted payment methods include those provided by Shopify and its partners, such as:

• Credit or debit card
• PayPal
• Other secure payment providers

All payments are processed securely using encrypted payment systems.

  1. Shipping and Delivery

Products are shipped to the delivery address provided by the customer.

Estimated delivery times are displayed at checkout. These are estimates only and may vary depending on the shipping carrier.

NAVIRAH is not responsible for delays caused by shipping carriers, customs, or circumstances beyond its control.

Risk of loss transfers to the customer upon confirmed delivery.

  1. Right of Withdrawal (EU Customers)

If you are located in the European Union, you have the legal right to withdraw from your purchase within 14 days of receiving the product, without providing a reason.

Returned products must be:

• Unused
• In original condition
• In original packaging

Return shipping costs are the responsibility of the customer unless the product is defective or incorrect.

  1. Refund Policy

If a withdrawal or return is approved, refunds will be processed within 14 days of:

• Receiving the returned product, or
• Receiving proof of return shipment

Refunds will be issued to the original payment method.

Shipping fees are non-refundable unless required by law.

NAVIRAH reserves the right to refuse refunds if returned products show signs of use, damage, or misuse.

  1. Consumer Guarantees (New Zealand Customers)

If you are located in New Zealand, the Consumer Guarantees Act 1993 applies.

Nothing in these Terms excludes, restricts, or modifies your rights under New Zealand consumer law.

If a product is faulty, defective, or not as described, you are entitled to a repair, replacement, or refund as required by New Zealand law.

  1. Legal Guarantees (France and EU)

Products are covered by:

• Legal guarantee of conformity (Articles L217-3 and following of the French Consumer Code)
• Guarantee against hidden defects (Articles 1641 and following of the French Civil Code)

These guarantees apply independently of any commercial warranty.

  1. Limitation of Liability

To the maximum extent permitted by law, NAVIRAH shall not be liable for:

• Improper use of products
• Indirect or consequential damages
• Losses caused by circumstances beyond reasonable control

Nothing in these Terms limits your mandatory legal rights.

Personal information is collected solely for order processing and customer service.

NAVIRAH complies with:

• GDPR (European Union)
• Applicable New Zealand privacy laws

  1. Force Majeure

NAVIRAH shall not be liable for failure or delay in performance caused by events beyond reasonable control, including but not limited to:

• Government restrictions

These Terms are governed by French law.

If you are a consumer residing in the European Union or New Zealand, you also benefit from mandatory protections provided by your local consumer laws.

Any dispute shall first be resolved amicably. If no resolution is reached, disputes may be brought before the competent courts as required by applicable law.
